Original video of the trial of the Bilbao Provincial Court
Apolozan case · ERDF fraud (Bilbao / Alicante / EU)
Article 743 of the Criminal Procedure Act provides that the sessions of the oral trial be recorded on audiovisual medium and that the authenticity and integrity of what is recorded be guaranteed by electronic signature, in the custody of the Clerk of the Administration of Justice. This annex is that record.
What the medium contains
- The files of the sessions of 31 January 2019 and 18 February 2019, named by the system itself with the date and time of start.
- The electronic signature files (.p7b) that accompany each video: the integrity guarantee that Article 743 of the Criminal Procedure Act requires.
- The system's official player (ARCONTE) and the series metadata, as the court delivers them.
Its dual evidentiary function
- Comparison reference: the incidents documented in A.18, A.21 and A.22 — cuts, lapses, absent stretches — are verified by comparing the delivered material with these files and their signatures. The comparison is technical and reproducible: it does not depend on anyone's testimony.
- Direct source: in what is recorded appear the statements of the plenary, including that of the complainant Cándido Iriarte on the volume of the materialised investment (A.22) and the treatment given to the accused in the courtroom (A.19).
The expert report that rests on it
The forensic criminalistics report of 19 July 2023 (A.33) takes this medium as a reference and concludes that the trial's audiovisual material was repeatedly altered. The conclusion is verifiable: the files, the signatures and the metadata remain available to any independent expert who wishes to repeat the examination.
How to verify it
Check the .p7b signatures against their videos; read the date and time metadata; play the sessions. The entire audiovisual block of the case (A.17–A.22) refers, ultimately, to this medium: whoever has it need not believe either of the parties.
