Video 1 - Manipulation of the recording in the Initial Phase of the Trial

Article 743 of the Criminal Procedure Act makes the audiovisual recording the record of the trial. This sequence documents how the beginning of this trial's record was constructed, on image.

The scene, as the sequence shows it

• The session of 31 January 2019 (First Section of the Provincial Court of Bizkaia) appears to begin: the public enters the room.
• When the recording resumes, the accused is already inside the room — the image does not capture him entering through the door.
• At the back, a witness is seen, also already present before the supposed start.
• Then, the attendees are cleared out of the room and called in again, staging the start of the session.

The missing stretch

Before that resumption, 11 minutes with no record elapse. What happened in the room during that stretch — with the accused and the witness already inside, as the later image itself shows — has no record. The cut is placed at around 10:10 in the morning, according to the description incorporated into the governing application of the case.

The three sources that fix the scene

• The sequence itself: the accused's reappearance without entering through the door and the witness at the back are visible in the image.
• Testimonial: the witness who appears at the back declared in writing and under oath what happened — including his expulsion from the room and the renewed call (A.20).
• Expert: the forensic criminalistics report of 19 July 2023 concludes the repeated alteration of the trial's audiovisual material (A.33), with the system's originals available for comparison (A.39.3).

Is there an ordinary explanation?

Hearings have pauses and systems have incidents. But a technical pause does not relocate people: it does not explain the accused appearing inside without having entered on image, nor a witness being in the room before the apparent start, nor the clearing-out and recall the sequence itself records. The ordinary explanation would have to cover the complete image — and the 11 minutes that would precede it.
