Application before the European Court of Human Rights on 24 June 2022, and Resolution of Non-admission

With the internal avenue closed, the European Convention offers its own. This annex documents the first attempt and its result.

The application

• Filed on 24 June 2022, within the time limit of Article 35 ECHR from the non-admission of the constitutional appeal (A.31).
• It invoked: Article 6 (fair trial), 6.2 (presumption of innocence), 8 (private and family life) and Article 1 of Protocol No. 1 (protection of property).
• It accompanied the documentary file: registry, administrative, audiovisual and patrimonial enforcement.

The result

The ECtHR did not admit it in single-judge format, with no material reasoning — the channel by which the Court disposes of the majority of the applications it receives. The merits — the dates, the registries, the cuts in the trial — remained unexamined in Strasbourg too.

The series datum

With this non-admission, the list of bodies that did not examine the documentary comparison adds its fifth element, now outside Spain. The 2024 application (A.39) would return to Strasbourg with what this one could not include: the 2023 forensic report on the recordings (A.33) and the internal refusal of the review (A.38).
