Video 5 - Testimony of the owner of Daxserv - Metin Rasim

On the ownership of a company there are two natural sources: the registry and the owner. This annex provides the second, recorded.

The medium

  • Video with internal recording metadata of 14 February 2019 — between the two sessions of the oral trial (A.39.3) —, integrated into the case's evidentiary USB.
  • Declarant: Metin Rasim, owner of Daxserv.
  • Playable from the portal itself: the original medium accompanies this annex.

What the owner declares

  • That Daxserv belongs to him.
  • That its administration was carried out by Fernando Carcedo, with the company domiciled at the latter's private residence.
  • That Apolozan is unconnected to the ownership and the management attributed to him.

The contrast with the accusatory attribution

The prosecution linked Apolozan with the management of Daxserv to extend the charged picture (A.11). Against that attribution there are: this statement of the owner, its corroboration by a second witness (A.39.2) and the accused's official address in Alicante. The registry check of the ownership — a matter of minutes — is not on record as carried out in the case.

How to verify it

Play the video and note the identity of the declarant and his assertions. Then look in the proceedings for the registry search on Daxserv. Statement available, check absent: that pair is the annex.

The factThe owner of Daxserv declares on camera the ownership and the real administration of the company attributed to Apolozan — and the case contains no registry check that would have settled the point.
The questionWhy was the management of a company attributed to an accused without carrying out the registry search that the file itself had one step away?
