An investigation file is assessed by two lists: that of the steps taken and that of those omitted. This annex allows both to be composed.
What is recorded as carried out
- Summonses to give a statement on 2 October 2014 (at 12:20 and 12:40, according to the writs).
- Requirements for banking information covering from May 2012 to 30 April 2014 — the exact period in which the management of the administrative file was carried out by the signatories of the application (A.1).
- Record-keeping steps and transfers proper to proceedings 1447/2014, derived from the April complaint (A.8).
What is not recorded as carried out
- No registry cross-check: the company's date of incorporation (A.1) and the status of its inscription (A.3) were not the subject of any step.
- No verification of the representation: the Administration's own requirement of powers (A.4) does not appear confronted.
- No incorporation of the Basque Government's 2012 audits and payments (A.5, A.10) into the object of the investigation.
The meaning of the asymmetry
The steps traced the accounts of the person designated without his signature on the application, and did not trace the acts of those who signed it. That orientation — verifiable by comparing the two lists — is the one that reached the oral trial intact (A.26).
How to verify it
Go through the annex's actions and note their recipients and objects. Then look for a single step aimed at checking registry dates or signatures on the application. The result of that search is the fact.
