Administrations publish their rules; files document their practice. This annex provides the rule.

The document

• BOPV No. 247, of 28 December 2022: Order of the Department of Economic Development, Sustainability and Environment of the Basque Government concerning the aid regime within the ERDF framework.
• Content: call, requirements, obligations of beneficiaries and of the Administration — the formal standard of the Basque aid circuit, published with all guarantees.

The comparison it enables

• The Order publishes requirements of standing and representation of the applicants; the case's file documents an application processed without powers despite the express requirement (A.4).
• The Order publishes the regime of justification and verification; the file documents a declaration of non-compliance that does not confront its own verifications and payments (A.5, A.6).
• The rule and the practice come from the same administrative apparatus, a decade apart.

What the piece serves for

Against the argument that the case's demands are constructions of a party, this gazette responds with the least suspect source possible: the Administration itself, in its official journal, describing how its aid must be processed. The standard is not set by the claimant.
